Fort Collins La Luz Mexican Grill sued after salmonella outbreak


Customers sickened in the August outbreak of salmonella illness at Fort Collins’ La Luz Mexican Grill have filed two lawsuits against the restaurant to demand compensation for damages.

The Seattle-based law firm Marler Clark, which specializes in representing victims of foodborne illnesses, and the Greenwood Village-based law firm Montgomery Little & Soran prepared the lawsuits. Both argued that La Luz failed in its duty to “exercise reasonable care in the manufacture of food products intended for human consumption,” among other complaints.

A Larimer County investigation confirmed 31 cases of salmonella illness were connected with the restaurant at 200 Walnut Street in Fort Collins, of which five required hospitalization. The restaurant voluntarily closed Aug. 21 and has not reopened.

The first lawsuit was filed on behalf of Fort Collins residents Jeffrey Allen and Marie Allen, as well as their five-year-old son, who as a minor is only referred to as S.A. in the complaint.

The complaint states that the five-year-old ate a chicken quesadilla, salsa and chips at La Luz Aug. 9, and two days later began experiencing acute salmonella symptoms of severe vomiting, diarrhea, stomach cramps, fever, fatigue and headache. He was hospitalized from Aug. 14-16, the complaint states.
